Personal Injury Law Services

Have I got a personal injury claim?

We deal with all sorts of personal injury compensation claims. You may, for example, have tripped over a paving stone or fallen from scaffolding. You may have been in a car crash or had an accident at work.

Whatever your problem, our personal injury compensation lawyers are here to help.

About making a personal injury claim

To obtain compensation for an injury or illness, this must be caused by the mistake or ‘fault’ of someone else. However, even if you are partly to blame, you may still have a case.

Claims must be brought within strict time limits – usually 3 years from the accident or for a child by the time he or she is 21, although there are exceptions.

What will I get?

There are two aspects to this.

Some of the compensation covers your pain and suffering. This is assessed with the assistance of expert medical evidence. There are guidelines referred to by the court for the amounts payable in respect of particular injuries.

The rest covers all your financial losses and expenses – both past and future. This can include loss of earnings and travel costs to and from hospital appointments.

Who will pay my costs?

The main options are:

No win No fee – for many clients this is the best option.

Legal Expenses Insurance – you may have an insurance policy to pay your legal costs, perhaps with your car or home insurance.  Did you know that you do not have to accept the law firm recommended by your insurer?

Private Paying – if you want to pay privately we will let you have our full terms of business, including our hourly rates.

Time Limits

The law states that court proceedings have to be issued within a certain time known as the limitation period. The time limits are strict and set out in the Limitation Act 1980.

If you do not comply with the limitation period that applies to your claim, you are likely to lose forever the chance to make your claim.

Most personal injury claims must be issued at court within three years of the date of the accident. For accidents to children the claim must be issued no later than their 21st birthday.

If you are not within 3 years we can give you advice. There may still be a way of making your claim.

1. Road Traffic Accidents

Road traffic accidents are unfortunately very common. One or more vehicles may be involved and drivers and/or passengers may be injured.

Some drivers are uninsured. Witnesses can be hard to chase. Sometimes there is an argument about who was to blame for the accident. It is important that we trace and interview witnesses as soon as possible. Very often we are able to overcome difficulties such as uninsured or untraced drivers and lack of witnesses. Often in even only a minor traffic accident, whiplash can cause severe and ongoing physical damage where compensation is appropriate.  Read more

2. Accidents at Work

Accidents in the workplace are all too common. Millions of pound are paid every year by way of compensation injury claims. Battrick Clark are one of the leading law firms dealing with work injury compensation for employees.

Work injury compensation claims generally fall into two main types:

Compensation for an injury caused by an accident; eg falling off scaffolding or getting trapped in a lift.
Industrial disease compensation claims, usually as a result of long term exposure to hazardous substances or chemicals.  Read more

3. Trips and Slips

Tripping accidents are common. They can occur on pavements, in supermarkets, in shops, on escalators, on stairs, at work, on public transport or within jointly owned properties in apartments etc.

Proving that the trip was at least partly someone else’s fault is essential and not always easy. Places like supermarkets must have a strict regime of regular inspection and cleaning. Flagstones on the highway are subject to inspection and repair. Everything depends on whether the person responsible for the area where the trip occurs has acted reasonably. We have dealt successfully with many such cases.   Read more

4. Other Injuries

Accidents that have caused your physical and mental damage can occur anywhere.

Provided that the fault lies either fully or partially with someone else, there may be a case for compensation. We have dealt successfully with cases of injuries caused whilst on holiday or away on business.   Read more

5. Useful Resources

We have put together a list of useful sources of support in the event of an accident or injury.

On this page you will be able to find details of NHS Direct, hospitals, physiotherapists and other support staff.   Read more
